At the time of posting I was not aware of the attribute 'IncludeEmptyResults'. 
This was the base functionality I was looking for.

A possible enhancement to this functionality would be to report what the problem
was when returning the GetFeatureInfo on that point.  I realize that this would
be a difficult task with relatively little return as there are several things to
consider (eg, ogc vs local datasource, non-descript error codes form servers, etc.).

Perhaps for the time being a default 'No results were found' (or something like
that) would be beneficial?

I like the idea of disabling the widget if no queryable layers are found,
however, would this functionality be dynamic?  What about the cases where users
can upload contexts into the current session - it's possible that the layers
added would have queryable functionality.
