In response to my own e-mail from August 2005, I have opened up a bug report and plan to commit changes to support theme_visible in the XMLThemeLegend widget parser, see for details:

This will allow you to have layers in your MAP file for which you don't want users to change the status off, like a dynamic selection layer etc.
