question: if the base layers are not available at certain scales, are there other layers (groups) that are 
visible or do you have a configuration where no layers are visible at a given scale?

I don't think the proposed fix is quite right for some reason ... it seems to me that it may be possible that 
the base layer (layers[0]) is not there but some other layer may be there in which case this could still fail.

Also there are some places in the code where this assumption of a base layer could be affected by this.
