I think there was some discussion of this a week or two ago - When using 
OVERLAYSYMBOL the legend does not always show the overlay symbol correctly, 
only the base symbol. I find that if the OVERLAYCOLOR is set to 255 255 
255, that while it is drawn correctly on the map, the legend displays the 
overlay symbol as transparent. The work-around is pretty easy: use 254 254 
254 for the overlay color.  Obviously, you will only detect this if your 
legend is set to transparent on. And it is possible that this behavior is 
peculiar to my map file.
