Yes, this is perfectly doable. MapServer doesn't know or care wether it was
called by a web browser or another app.

Our site uses the technique you describe, and it's been working great for
us.

You can also use the mode=legend (if I remember correctly) to ONLY get a
legend back.

Are legends only created when MapServer is called from a web page?  I would
like to call MapServer from an app (using a URL) in addition to  the web,
and use the legend image it creates within my app.  Is this possible?
