A postscript,

It SEEMS to work....
but if all the layers in the map have the same group name, startUp.js will
fire the 'no queryable layers at this scale and extent' message and fail
to execute the query.

where the issue was NO group names.

The next workaround is to comment out everything associated with the
test    if(layers.length == 0)      in startUp.js
